PHOTOGRAPHY TERMS
In the following terms & conditions “the photographer” shall mean Priya Walia trading as SORRISO Wedding Photography at the business address: 22, Coronation Road, Wednesfield, Wolverhampton, West Midlands, WV10 0QH.
“The client(s)” shall be those persons defined as the named persons in the contract.
The client(s) cannot vary these terms and conditions in any way unless the photographer in writing expressly agrees such conditions.
The photography contract is a “mixed” contract, which includes both “goods” and “services”. The ‘services’ part includes but is not limited to the venue visit, engagement shoot, wedding photography coverage on your wedding day, and the processing and editing of files afterwards.
The ‘goods’ refers to the digital download of engagement shoot photographs and the USB drive that contains your wedding photographs and any books, albums or prints if these are included as part of your chosen wedding photography package.
1. Payments:
a. The payment of the services and goods confirmed on the contract is divided into a booking fee and a remaining balance payment.
b. The booking fee is a non-refundable, non-transferrable security deposit of £350 of the services and goods confirmed on the contract.
c. The booking fee is required upon booking the required services and goods and the remaining balance is due 4 weeks prior to the event date
d. The booking fee is the acceptance of the terms and conditions.
e. The booking fee will be deducted from the cost of the client(s) full package when calculating the final balance due.
f. Full payment for last minute bookings will be required 1 week before the event.
g. Additional goods ordered must be paid for in full at the time of ordering.
2. Pricing:
a. All standard photography packages and additional goods specified on the contract are supplied at the prices ruling on the date of booking. Goods not specified on the booking form are supplied at the prices ruling at the time of receipt of the order
3. Client Relationship
a. SORRISO Wedding Photography is acting as an independent contractor. Therefore, SORRISO Wedding Photography is not entering into a partnership with the client(s) and shall endeavour to meet the requirements of the client(s) within the brand and styling of the business.
b. SORRISO Wedding Photography has the right to seek advice or assistance if and when required.
Timescale and Deadlines
a. Timescales and deadlines are estimations only. Timescale and deadlines may change during the photographer’s busiest time of year. The photographer’s busiest time of year is estimated from June to September.
b. The photographer aims to fulfill all work within the timescale given.
c. In cases of deadline delays due to unforeseen circumstances or events out of the control of the photographer, client(s) will be notified and kept updated.
d. The photographer is not responsible for delays in deadlines in the event of not receiving communication from the client(s) for 3 days or more.
4. Licenses, Coverage and Reproduction:
a. Photographs taken during the course of the event will be at the discretion of the photographer, although every effort will be made to comply with the client(s) requirements.
b. The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer’s judgement regarding these matters shall be deemed correct.
c. The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out. The client(s) should discuss the inclusion of important persons within the images.
d. For a booking involving a church ceremony and other religious venues, the official photographer’s movements are sometimes restricted by the conductor of the event or persons in charge of the venue. The area from which the photographer is able to cover the ceremony may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
e. Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.
f. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure out of their control.
5. Copyright:
a. The copyright Designs and Patents Acts assign the copyright of the images to the photographer.
6. Display:
a. The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, marketing and promotional materials such as, websites, blogs, social media, sample albums, brochures, magazine articles etc.
7. Ownership:
b. All digital negatives (RAW computer files) remain the property of the photographer. Digital negatives will not be issued to client(s). The photographer will edit each photograph to suit the requirements of the business brand. Client(s) will be issued edited and completed work. All digital negatives will be held for a minimum of 3 years before being permanently deleted.
c. Client(s) are not authorised to edit or crop photographs in any way, shape or form for social networking or other personal usage. The final photographs that are issued to the client(s) represent the photographer’s business, brand and style of work. It is important that client(s) respect this and maintain the standards of the photographer’s business, brand and style of work.
8. Force Majeure:
a. The photographer will endeavour to put the client(s) in touch with another photographer in the unlikely event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc.
b. In the very unlikely event of cancellation by the photographer, or in the very unlikely event of total photographic failure, a full refund minus the non-refundable security deposit will be issued by cheque or BACS.
9. Cancellations
a. The client(s) has a right to cancel at any time during the cancellation period without giving any reason, and without incurring any liability. A cancellation request will be required in writing. Email cancellation requests will be accepted. The cancellation period ends at the end of 14 days after the day on which the contract is entered into.
b. For cancellation requests received after the 14 day period are as follows:
14 days after booking and >1 year before the wedding date: £450 (booking fee)
14 days after booking and >6 months before the wedding date: £450 + 25% of balance
14 days after booking and <6 months before the wedding date: £450 + 50% of balance
c. If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:
d. The non-refundable security deposit ensures that in the event of the client(s) cancelling the contract, the photographer’s loss of earnings are covered.
10. Photographic Coverage
a. The photographer is the only authorised and official photographer for your event day. The photographer will work for a maximum of 10 hours for full day event coverage. Additional hours will be charged at £80 per hour.
b. The latest the photographer will work to on any event day is 12am.
c. A meal within the dietary requirements for the photographic team must be provided if evening coverage is requested as it in your best interests that the photographic team remain on the premises for the best coverage of your event
11. Pre-Wedding Engagement Photo-shoot.
a. Pre-wedding engagement photo-shoots are optional. The pre-wedding engagement photo-shoot will take place at the photographer’s agreed local location. The client(s) can suggest locations within a 45 minutes travel time from the photographer’s business address. The client(s) must seek permission and confirm any necessary agreements and payments with their chosen location before confirming with the photographer.
12. Print Products
1. Albums
a. Albums are supplied in 10×10 inches with 30 pages (15 double page spreads) and 12×12 inches with 40 pages (20 double page spreads).
b. Should the client wish to order an alternative size or orientation of album or extra pages, there will be an extra charge, which are subject to the prevailing rates at the time the album is ordered.
c. It is the responsibility of the client(s) to select their photographs for their event album. Up to 80 photographs can be selected but not all of the photographs will be used within the album. The photograph selection will act as a rough guide to curate the closest representation of the client(s) event day. The photographer will design the client(s) album with their selected photographs and create a proof for the client(s) to suggest refinements.
d. Client(s) will be given 2 rounds of refinements before their album is confirmed for printing. Further rounds of refinements will be charged at £30 per round.
e. The client(s) should complete photograph selections within 4 weeks after the photographer has handed over all official photographs of the client(s) event. Final refinements for the client(s) album must be completed within 3 months after the photographer has handed over all official photographs.
f. The photographer is not responsible for delays in album deadlines in the event of not receiving prompt communication from the client(s). Albums are printed by UK based manufacturers, which may experience delays in turnaround times during peak wedding seasons. Therefore the photographer is not responsible for any printing delays out of their control. The photographer will aim to complete all album designs within 3 months of handing over the official event photographs. Client(s) are responsible for collecting their albums and products once the photographer confirms receipt of the album.
2. Guest Signing Books
a. Guest signing books are available for client(s) who have had a pre-event photo shoot with the photographer. The client is responsible for selecting 15 photographs for their guest signing book. The guest signing book must be completed and printed a minimum of 4 weeks before the confirmed event date.
b. The photographer accepts no responsibility whatsoever for damages caused to the any guest signing book provided by the business during the event day. The Guestbook is supplied “as is” and the usage is at the client(s) own risk.
3. Prints
a. Single prints of any photographs taken by the photographer are available to order in various sizes. Singular prints are supplied at the prices ruling at the time of receiving the client(s) of the order.
Digital Products
1. Online Password Protected Gallery
a. Client(s) will receive an online password protected gallery of their event photographs a minimum of 2 month after the event date. The online password protected gallery acts as a secure backup of all photographs for the client(s) event.
b. The online gallery is supplied by a 3rd party business. The photographer is not responsible for any software or hardware changes the online gallery may experience, or the unavailability of the gallery due to maintenance. The photographer will keep the client(s) up to date, should the 3rd party wish to change their online gallery platform.
2. USBs
a. Client(s) will receive a business branded USB of all photographs of their event date taken by the photographer. A 3rd party company manufactures the USBs, therefore the photographer is not responsible for any cosmetic or internal damage to the USBs. The photographer will endeavour to resolve any issues with the 3rd party company if USBs are not up to standard before handing over. The USB will be handed over once the client(s) chosen photography coverage package is complete.
b. Clients are encouraged to make copies of the USB for backup and security purposes.
15. Delivery:
a. It is preferred that all albums, prints and USBs are collected by the client(s) from the photographer at an arranged date and time unless otherwise agreed.
b. If client(s) prefer for their products to be posted via courier, the client(s) must pay for courier and insurance fees incurred.
16. Personal Accident
a. Any directions issued to client(s), their guests or employees during a photographic shoot are deemed to be at said persons’ own risk. The photographer cannot be held responsible for any personal accidents or damages during a photographic shoot.
b. If the client(s) wish to suggest and carry out an idea for a particular photograph, they do so at their own risk. The photographer will always ensure photographs are taken within a safe environment where the client(s) and their guests are comfortable.
c. If the photographer deems an idea unsafe, the photographer has the right to refuse participating in the photographing of the idea.
Photographer and Guest Conduct
a. The photographer endeavours to work respectfully, professionally and in a timely manner to ensure the mains events of the day are documented with ease. The photographer therefore requires a detailed timeline of events 4 weeks prior the coverage of the event.
b. The client(s) holds responsibility to inform the photographer of any sensitive situations between guests.
c. SORRISO Wedding Photography and any persons representing the business on the day of the event coverage has the right to leave the premises should they feel unsafe or I’ll treated by any guests.
16. Complaints
a. Any complaints should be made via email. Priya Walia of SORRISO Wedding Photography is a member of The Guild of Professional Photographers, and as such abides by their strict code of conduct. Complaints will be responded to within 7 working days.
